AIA Patent Trial and Appeal Board Update

Brooks Kushman Shareholder Frank Angileri discusses several recent Federal Circuit decisions involving AIA post-grant proceedings before the USPTO Patent Trial and Appeal Board. The Federal Circuit shows a tendency to defer to the PTAB on procedural issues, but to closely review claim construction and other substantive issues. Frank also discusses the USPTO’s newly revised PTAB trial rules and their impact. The webinar also discusses recently published final rules modifying some procedures used in AIA PTAB trials.
