SOUTHFIELD, Mich. – Brooks Kushman Chief Executive Officer, Sangeeta Shah, will be speaking during a panel discussion at the Patent Trial and Appeal Board (PTAB) Bar Association Annual Conference on March 24, 2022. Shah’s panel, “The Interplay between Ex Parte Reexamination and Inter Partes Review,” will explore the interplay between reexamination and inter partes review including: reexam strategies after In re Vivint, 325(d) applied to reexam, and serial reexams. Panelists will also discuss reexamination statistics and strategic use of both reexaminations and reissues.
The conference brings together practitioners, in-house counsel, and members of the bench for a dynamic discussion of the PTAB best practices, recent developments and trends, and policy considerations. On the panel, Shah joins the United States Patent Trademark Office’s (USPTO) Director of Central Reexamination Unit; Deputy Chief Judge of the USPTO Patent Trial and Appeal Board well as several distinguished members of the Bar.
Shah is an IP practitioner with over 20 years of experience in managing patent portfolios, PTAB matters, patent litigation, and opinions/agreements. She represents several Fortune 500 clients for whom she provides strategic counseling and guidance on global intellectual property portfolios. She served as counsel in over 40 IPR proceedings for various technologies. Shah recently defended an automotive supplier in an IPR proceeding (patent owner) challenging claims in a patent related to drivelines. PTAB found petitioner failed to prove the obviousness of the claims and ruled the claims patentable. The Federal Circuit agreed and dismissed the appeal in a precedential opinion on standing. Shah has been named one of the Top 50 Women in PTAB Trials in 2020 and 2021.
