Lawyer for MTU Student Says Grokster Decision Applies

An article in the April 28, 2003 PM Update on RadioandRecords.com quoted Tom Lewry about the decision by a Los Angeles federal judge that Grokster Ltd, StreamCast Networks Inc. and Kazaa BV are not liable for copyright infringement committed by users of their file-sharing software.

“The courts (sic) ruling confirms that the RIAA must prove that the students had actual – not merely constructive – knowledge of the infringement,” said Lewry. Lewry is defending Michigan Technology University student Joe Nievelt in the RIAA’s suit over a Napster-like file-sharing service Nievelt operated on campus.
