Marc Lorelli Featured In Corporate Counsel Article Focused On Open Source Software ACC Panel

SOUTHFIELD, MI – Brooks Kushman Shareholder Marc Lorelli was showcased in Corporate Counsel’s June 22, 2018 article, “Open Source Software: Great for Engineers, Tougher for In-House Attorneys.” The article was written about the Association of Corporate Counsel (ACC) Corporate Counsel University, a two-day program featuring panels that focus on various areas of corporate law. The program is designed specifically for attorneys who are new to in-house practice, or looking to sharpen their basic practice skills. Topics range from data privacy and employment to finance and intellectual property.

Lorelli spoke on a panel at the event regarding open source software and its relationship with Intellectual Property law. In an example, he discussed the possible implications of a ride sharing app using open source code without considering the impact it could have on their intellectual property. “I don’t have to deal with figuring out how to develop GPS,” Lorelli said, “Somebody has already done it. It’s very effective. But if I put it in my code, I could end up owing the app to somebody else or having to disclose it publicly. I basically just lost the company’s crown jewels if I use open source in an improper way or a way that isn’t consistent with the license that I signed up for by pulling it off of the internet.”

Lorelli is co-chair of Brooks Kushman’s intellectual property litigation practice. He has successfully tried patent, trademark, trade secret and copyright cases in Federal Courts nationwide. He has also practiced before the Federal Circuit Court of Appeals, and the International Trade Commission. Lorelli also has extensive experience with post-grant proceedings before the U.S. Patent and Trademark Office including re-examination and inter partes review.
