SOUTHFIELD, Mich. – Brooks Kushman Shareholder Kristin Murphy and Associate John Rondini review two companion Covered Business Method (CBM) cases – captioned Liberty Mutual Ins. Co. V. Progressive Casualty Ins. Co. – and the Patent Trial and Appeal Board`s (PTAB) final decision in the article “PTAB Confirms Viability of Priority-Based Challenges” recently published by Law360.

According to the article, “these two decisions provide practitioners with guidance on attacking CBM petitions, as well as how to address priority issues related to continuation-in-part (CIP) patents, thereby giving rise to prosecution strategies to limit such attacks.”
