January 2, 2012 – Brooks Kushman patent attorney in Michigan, Tom Lewry was quoted in the National Law Journal article, “A Revived Injunction:  Federal Circuit Recently Affirmed Vitality of this Patent Remedy.”  Several years ago the U.S. Supreme Court in eBay v. MercExchange held that permanent injunctions could no longer be issued automatically in patent infringement cases.  However, lately, federal judges have issued injunctions.  Tom Lewry says, these recent cases “point out a patent is a property right and it needs to be respected.  That`s something that had been lost for a while under eBay.”  The article continues to discuss the impact of Injunctions in pharmaceutical cases and Lewry states, “Injunctions in pharmaceutical cases can be very costly.  There`s hundreds of millions of dollars at stake.”
